Successful representation of Grupo Comex’s affiliates in anti-dumping investigation

Arias, Fábrega & Fábrega represented Grupo Comex's affiliates Pinturas del Istmo, S.A. and Distribuidora Kroma, S.A de CV in connection with an anti-dumping investigation lead by the Office of Commercial Treaties and of Defense of Commercial Interests of the Ministry of Commerce.

The investigation initiated following petition of a competitor, who sought the imposition of anti-dumping measures on oil and water-based paints imported from the U.S., Mexico, Guatemala, and El Salvador to Panama, produced by certain competitors including the Grupo Comex affiliates. 

In a joint effort with Mexican law firm Avila Law, ARIFA succeeded in demonstrating that Distribuidora Kroma, S.A. had zero dumping margins and that therefore there was no threat of harm to the national production of the relevant market. As a result the Office of Commercial Treaties and of Defense of Commercial Interests adopted a resolution stating its position to not recommend the imposition of anti-dumping measures on the investigated companies.
